Skilled Worker Immigration and Express Entry

There are three main categories for skilled worker immigration: Federal Program, Quebec Program, and Various Provincial Nominee Programs (PNPs). Federal Program includes Federal Skilled Worker program (FSWP), Federal Skilled Trades program (FSTP) and Canadian Experience Class (CEC). You can find brief descriptions on these programs from below tabs.

Express Entry: Please note that starting January 2015, Express Entry is introduced for Federal Programs and some Provincial Programs. First, the candidate submits Express Entry application and based on complete application then the Invitation to Apply (ITA) will be processed within 6 months. CIC will select candidates that are most likely to succeed in Canada, rather than the first in line, thus there will be skills based ranking system. Invitation to Apply (ITA) is guaranteed for candidates with valid job offers or Provincial/Territorial Nominations. Canadian employers will have access to pool of candidates if they cannot find Canadians or permanent residents for the positions.

1. Express Interest

Express Entry submission will be assessed based on Language proficiency, Education, Canadian work experience, Other factors that lead to success in Canada. Candidates meeting the minimum criteria for one of the three Federal programs (FSWP, FSTP, CEC) will be placed in the pool. Candidates should register with Job Bank and promote themselves.

2. Invitation to Apply

Candidates with an ITA can apply for permanent residence through one of the federal programs (FSWP, FSTP, CEC). Provinces and Territories can also nominate candidates in the pool, where the candidates are required to meet the minimum entry criteria.

Comprehensive Ranking System (CRS): Candidates will be assessed based on this points-based system (Maximum points: 1200) and will be ranked in the Express Entry pool. Skills, work experience, language ability, education and other factors will count towards the points. If the candidate has a job offer or a provincial nomination, an additional 600 points will be awarded. For more information, an interested applicant should contact Marvin Moses Law Office to discuss the suitability of application under one of these programs.

Final Note:

In some cases, persons seeking to file a Skilled Worker Immigration Application, apply themselves. However for cases, where Canadian immigration rejects the applicant, the second attempt is much more difficult. Where the application is less than straightforward, an applicant seeking the safest and least risky approach for applying for a Skilled Worker Immigration Application, should seek professional assistance from the start.

Obtaining legal advice is very important, especially in complicated situations, to better lay the foundation for a successful application, especially in the current environment where Immigration authorities have become stricter in applying the skilled worker immigration application criteria rules and regulations. Further, given that there are now a few different categories within the skilled worker application in which one may select to qualify for immigration, there is a greater need to speak to a qualified immigration lawyer about the risks and pitfalls. As always, the prospective skilled worker immigration applicant, should seek proper and honest legal advice in order that the prospective immigration applicant does not lose the right to obtain the sought after immigration visa.
